1. Agreement to Terms
By accessing or using rsvp-ify (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and rsvp-ify ("we," "us," or "our").
The Service allows users to create event pages, share them, and collect RSVPs without requiring account registration.
2. Definitions
- "Service" refers to the rsvp-ify web application and all its features.
- "User" refers to any individual who accesses or uses the Service.
- "Event Host" refers to a User who creates an event through the Service.
- "Guest" refers to a User who submits an RSVP or comment on an event.
- "User Content" refers to any content submitted by Users, including event details, RSVPs, and comments.
- "Host Token" refers to the unique access token provided to Event Hosts for managing their events.
3. Use of the Service
The Service is provided free of charge. You may use the Service to:
- Create event pages with details such as title, date, time, location, and description
- Share event page links with others
- Submit RSVPs to events
- Post comments on event discussion sections
- Manage events you have created (edit, delete) using your Host Token
No account registration is required to use the Service. Event management is controlled through Host Tokens, which are provided at the time of event creation.
4. Host Token Responsibility
When you create an event, you receive a unique Host Token in the URL. This token grants full control over the event, including editing and deletion.
- You are solely responsible for safeguarding your Host Token.
- Anyone with access to your Host Token can modify or delete your event.
- We cannot recover lost Host Tokens. If you lose your Host Token, you will be unable to manage your event.
- We are not liable for unauthorized access resulting from shared or compromised Host Tokens.
5. Acceptable Use Policy
You agree not to use the Service to:
- Create events for illegal activities or purposes
- Post content that is defamatory, obscene, harassing, threatening, or hateful
- Impersonate any person or entity
- Submit false or misleading information
- Distribute spam, unsolicited messages, or promotional materials
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service, servers, or networks
- Use automated means (bots, scrapers) to access the Service without permission
- Violate any applicable law or regulation
- Collect personal information of other Users without their consent
- Post content that infringes on intellectual property or privacy rights of others
We reserve the right to remove any content or event that violates these Terms, without prior notice.
6. User Content
You retain ownership of any content you submit through the Service. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute such content solely for the purpose of operating and providing the Service.
You represent and warrant that:
- You have the right to submit the content you provide
- Your content does not violate any third-party rights
- Your content complies with these Terms and all applicable laws
We do not endorse, verify, or assume liability for any User Content. Event details, RSVPs, and comments are submitted by Users and do not reflect our views.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect and use your information.
8. Third-Party Services
The Service relies on third-party infrastructure providers (such as Supabase for data storage and hosting). We are not responsible for the availability, accuracy, or reliability of third-party services. Your data may be processed by these providers in accordance with their own terms and privacy policies.
Event pages may contain links or references to third-party websites (e.g., Zoom links, venue websites). We do not control or endorse third-party content and are not responsible for it.
9. Intellectual Property
The Service, including its design, code, features, and branding, is owned by rsvp-ify and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our express written permission.
The rsvp-ify name, logo, and associated branding are our property. You may not use them without prior written consent.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) ANY RESULTS OBTAINED THROUGH THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (D) ANY DEFECTS IN THE SERVICE WILL BE CORRECTED.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RSVP-IFY, ITS AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
12. Indemnification
You agree to indemnify, defend, and hold harmless rsvp-ify and its contributors from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your User Content
- Any event you create or manage through the Service
13. Service Availability & Modifications
We do not guarantee that the Service will be available at all times. The Service may be subject to interruptions for maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.
14. Termination
We may remove any event or content, or restrict access to the Service, at any time and for any reason, including violation of these Terms. Since there are no user accounts, "termination" means removal of your content and/or blocking access to the Service.
Upon removal of an event, all associated data (RSVPs, comments) is permanently deleted and cannot be recovered.
Sections 6 (User Content license), 10 (Disclaimers), 11 (Liability), 12 (Indemnification), and 15 (Dispute Resolution) survive termination.
15. Dispute Resolution
Before initiating any formal proceedings, you agree to attempt to resolve any dispute informally by contacting us. We will make a good-faith effort to resolve the dispute within thirty (30) days.
Any claim arising from these Terms or the Service must be filed within one (1) year after the claim arose, or the claim is permanently barred.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
16. Force Majeure
We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, cyberattacks, power outages, Internet disruptions, or third-party service provider failures.
17. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and rsvp-ify regarding the Service.
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
- No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
18. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.
